ASSESSMENT
RATIONALE
The purpose of this assessment task is for you to identify the safety, environmental and
heritage legal obligations triggered by the construction project case study provided.
CRITERIA C1: Identify aspects of construction projects that may trigger legal obligations. (40%)
C2: Identify and apply relevant legislation. (40%)
C3: Communicate information using prescribed format. (20%)

Assessment Task Description:
You are required to develop a legal register for the project. This task will require you to consider the
work being conducted, the location of the works, and the needs of neighbouring land users.
Based on the case study, you will select a civil or building scope of works and develop a legal
register made up of work health and safety, contractor, environmental and heritage obligations.
Task instructions
Read the details of the hypothetical construction project in the ‘ZAX103 AT2 template_draft.docx
document and select either the building scope of works
or the civil scope of works. Consider the work
being conducted, the location of the works, and the needs of neighbouring land users. Then, based
on your selected scope of works:
1. Develop a legal register made up of work health and safety, contractor, environmental and
heritage obligations. Identify and state the main Acts or Regulations that you believe apply.
Legislation is extremely complex, so you need only name the legislation by title and provide a
sentence explaining its importance and why you believe it applies.
2. Briefly describe why it is important to comply with health and safety obligations.
3. Briefly describe why it is important to comply with heritage and environmental legal
obligations.
4. In approximately 300 words or through dot points, outline:
requirements for setting up the construction site (e.g., signage, access control, facilities)
documentation required for a construction project greater than $250,000
training required by workers
requirements for consultation (e.g., who would you need to consult with? What would
you need to consult with them about?)

(NB. Review the Construction Code of Practice for assistance in completing the above dot
points.)
You may present your legal register and descriptions for steps 1-4 above using the Word template
provided on MyLO or using your own format if you wish. Please ensure you state the scope of works
you have chosen (civil
or building) from below.
Hypothetical project:
The project is to undertake civil, and construction works to build a new hotel on a ‘brown-fields’ site.
Through tender documents you are informed that:
The site has previously been used as an oil storage facility and general waste landfill and may
be contaminated.
There may be items of Aboriginal or cultural heritage significance in the area.
There is the potential to encounter underground services and redundant town gas lines.
The site is adjacent to a busy retail and restaurant area with accommodation venues.
Select either a civil scope of work or a building scope of works depending on your sector or interest:
Civil scope of works:
Excavation of footings to natural ground level for a substation and building
Additional piling to natural ground level if not achieved through excavation
Installation for formwork, reinforcing and concrete
Excavate trenches to a depth of 1.5m for High Voltage (HV) services
Install HV cables, slabbing and warning labels.
Building scope of works:
Procure, supply and deliver to site all materials required for construction of the hotel as per the
provided drawings and design information
Construct building as per design
Install and commission all services and fire systems
Handover at lockup stage to fit-out contractors.
Format
Word or Excel or similar. Legal register should be in tabulated format. A template has been provided,
but you may create your own.

Plagiarism
Plagiarism is a form of cheating. It is taking and using someone else’s thoughts, writings or
inventions and representing them as your own; for example, using an author’s words without
putting them in quotation marks and citing the source, using an author’s ideas without proper
acknowledgment and citation, copying another student’s work. If you have any doubts about how
to refer to the work of others in your assignments, please consult your lecturer or tutor for relevant
referencing guidelines. You may also find the
Academic Honesty site on MyLO of assistance.
